1. Acceptance of Terms
By accessing and using the Obsidian Innovations website and services, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our website or services.
2. Services
Obsidian Innovations provides custom home building, barndominium construction, remodeling, and related construction services in the Texas Hill Country and surrounding areas. All services are subject to a separate written contract agreed upon by both parties prior to the start of any project.
3. Estimates and Quotes
All estimates and quotes provided by Obsidian Innovations are valid for 30 days from the date of issue. Final project costs may vary based on material prices, scope changes, and site conditions discovered during construction.
4. Payment Terms
Payment schedules are outlined in the individual project contract. Failure to make payments according to the agreed schedule may result in work stoppage until payment is received. Obsidian Innovations reserves the right to charge interest on overdue balances.
5. Project Changes
Any changes to the agreed project scope must be submitted in writing and approved by both parties. Additional costs resulting from scope changes will be outlined in a written change order before work proceeds.
6. Permits and Compliance
Obsidian Innovations will obtain all required building permits for contracted projects where applicable. The client is responsible for ensuring the property complies with local zoning and deed restriction requirements prior to the start of construction.
7. Warranties
Obsidian Innovations stands behind the quality of its workmanship. Warranty terms are outlined in the individual project contract. Warranties do not cover damage resulting from misuse, neglect, unauthorized modifications, or acts of nature.
8. Limitation of Liability
Obsidian Innovations is not liable for delays caused by weather, material shortages, supply chain disruptions, or circumstances beyond our control. Our total liability for any claim related to a project shall not exceed the total amount paid by the client for that project.
9. Intellectual Property
All content on the Obsidian Innovations website including text, images, logos, and graphics is the property of Obsidian Innovations. Unauthorized use or reproduction of any content is strictly prohibited.
10. Privacy
Any personal information collected through our website or contact forms is used solely for the purpose of responding to inquiries and managing client relationships. We do not sell or share your information with third parties.
11. Governing Law
These Terms and Conditions are governed by the laws of the State of Texas. Any disputes arising from these terms or our services shall be resolved in the courts of Gillespie County, Texas.
12. Changes to Terms
Obsidian Innovations reserves the right to update these Terms and Conditions at any time. Changes will be posted on this page with an updated effective date. Continued use of our website following any changes constitutes acceptance of the revised terms.
